Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Nomi app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a legal agreement between you and Sunflower Mori Studio ("we", "us", "our"), the developer of Nomi.

2. Eligibility

You must be at least 18 years of age to use Nomi. By using the App you confirm that you are 18 or older. If you are under 18, you are not permitted to create an account or use the App.

3. Your Account

To use Nomi, you must create an account using a valid email address or a supported OAuth provider (Google, Apple). You are responsible for:

• Keeping your login credentials secure and confidential.
• All activity that occurs under your account.
• Notifying us immediately at support@sunflowermori.com if you suspect unauthorised access.

You may not create an account on behalf of another person, or share your account with others.

4. Free Plan & Pro Subscription

Nomi offers a free tier and an optional paid subscription ("Nomi Pro"). The free tier is always available and includes the core features of the App.

Nomi Pro unlocks additional features (extended focus modes, music library, multiple active tasks, custom task builder, and full rhythm insights). Pro is available as a monthly or annual subscription managed through the Apple App Store or Google Play Store via RevenueCat.

• Free trial: Annual plans may include a 7-day free trial for new subscribers. No charge is made until the trial period ends. You can cancel before the trial ends to avoid being charged.
• Billing: Subscriptions renew automatically at the end of each billing cycle unless cancelled in your device's subscription settings at least 24 hours before the renewal date.
• Price changes: We may change subscription prices with reasonable advance notice. Continued use after a price change constitutes acceptance.
• Refunds: All purchases are handled by Apple or Google. Refund requests must be submitted to the respective store. We are unable to issue refunds directly.

5. Cancellation

You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until that date. Cancellation does not entitle you to a refund for the current period.

To delete your account and all your data, go to Profile → Delete Account in the App. Account deletion is immediate and permanent.

6. Health & Wellness Disclaimer

Content in the App (check-in prompts, focus suggestions, affirmations) is for general informational and motivational purposes only. If you have concerns about your mental health, please consult a qualified healthcare professional. Do not delay or disregard professional medical advice because of anything you read or experience in Nomi.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to our systems, servers, or another user's account.
• Reverse-engineer, decompile, or disassemble the App or its underlying code.
• Use automated scripts or bots to interact with the App.
• Resell, sublicense, or commercially exploit any part of the App without our written consent.
• Upload or transmit viruses, malware, or other harmful code.

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

8. Intellectual Property

The App, its design, code, brand, and content (excluding content you create) are owned by Sunflower Mori Studio and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the App solely for your personal, non-commercial use.

You retain ownership of any content you enter into the App (task names, notes, check-in entries). You grant us a limited licence to store and display that content in order to operate the App for you.

9. Availability & Changes

We strive to keep Nomi available, but we do not guarantee uninterrupted service. We may update, modify, or discontinue features at any time. We will provide reasonable notice for significant changes that affect paid features.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Sunflower Mori Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the App, including loss of data, profits, or goodwill.

Our total liability to you for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim (or USD $10 if you have paid nothing).

11. Indemnification

You agree to indemnify and hold harmless Sunflower Mori Studio and its affiliates, officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Sunflower Mori Studio is registered, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective date" at the top of this page and, for material changes, notify you via an in-app notice. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
